The costs of arbitration, including administrative fees, shall be allocated as determined by the AAA Consumer Arbitration Rules, except that each party shall bear its own attorney's fees unless the arbitrator determines that a claim was brought in bad faith.

11.3 Class Action Waiver

YOU AND EAST COAST WINGS AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS-WIDE ARBITRATIONS, PRIVATE ATTORNEY GENERAL ACTIONS, AND ANY OTHER PROCEEDINGS WHERE SOMEONE ACTS IN A REPRESENTATIVE CAPACITY. YOU EXPRESSLY WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
